-Grant Western Communications Inc. world-wide, royalty-free, perpetual, irrevocable, non-exclusive rights to display the image in any way we choose, in any medium, for as long as we wish.
-Represent and warrant that you own the photo and can assign all copyrights and other intellectual property rights (including any moral rights) in and to the photo, and that the photo is not copyrighted by any person or entity other than you.
-Will not submit photos containing cartoons, nudity, promotional material or advertising.
-Represent and warrant that the photo will not breach any rights of privacy, rights of publicity or any other rights of any third party.
-Represent and warrant that you are over 13.
-Represent and warrant the registration information you submit is true and accurate.
-Will indemnify, defend, and hold harmless us, our agents, affiliates, subsidiaries, officers, and employees (collectively “Indemnified Parties”) from and against any and all third-party claims, liability, loss, and expenses (including damage awards, settlement amounts, and reasonable legal fees), brought against any Indemnified Parties arising out of or related to: (a) your breach of any provision of this agreement; or (b) your willful misconduct or gross negligence. Photos will be reviewed before they are published and we reserve the right to refuse to publish any photo for any reason. Once submitted, the physical photo you submit becomes the property of Western Communications Inc. and will not be returned even if it is not published.
